A former executive at Activision, who chooses to remain anonymous, has filed a lawsuit in California against the gaming giant, accusing the company of age discrimination and violating whistleblower protection laws. This 57-year-old executive, along with six other individuals aged 47 or older, was reportedly let go from a team of 200 employees as part of a restructuring effort by Activision Blizzard in August of last year. The lawsuit claims that Bobby Kotick, the recently-departed CEO of Activision Blizzard, made discriminatory remarks regarding the presence of older white men at the company.

Ageism and Discrimination in the Gaming Industry

The issue of ageism within the gaming industry is not a new phenomenon. Many industry professionals have raised concerns about the challenges faced by older employees. Timothy Cain, one of the original designers of Fallout, referred to ageism as “the last publicly acceptable discrimination” in game development. A CompTIA survey conducted in 2023 revealed that only 17% of tech workers and 14% of software developers and engineers in the United States are over the age of 55. These statistics highlight the age bias prevalent in the industry.

While the lawsuit focuses specifically on age discrimination, it is worth noting the broader issue of diversity and inclusion within Activision Blizzard. The company’s most recent Diversity, Equity, and Inclusion Look-Back report indicates that 73% of its workforce is male, and 61% of their US workforce is white. These numbers suggest that diversity and representation are areas in need of improvement.

The anonymous plaintiff seeks damages for various losses, including financial impact, damage to career advancement, harm to their reputation, emotional distress, and wrongful termination. They also request reimbursement for legal expenses. The lawsuit sheds light on the importance of checks and balances within companies to address discriminatory practices and protect employees from false accusations.

Activision Blizzard has yet to provide extensive comment regarding the age discrimination allegations. They have directed inquiries to their equal employment opportunity policy. It is crucial for companies to acknowledge and address such allegations seriously and take appropriate action to ensure a fair and inclusive work environment.
